AMUSEMENT RIDE ACCIDENT LAWYERS

Karon & Dalimonte, LLP has a national practice representing persons seriously injured in an amusement ride accident.  Lawyers from our firm have experience with cases involving all types of amusement rides, including fixed rides, mobile rides and go-karts.  Each year thousands of people are injured in amusement ride accidents and many of these injuries could have been prevented if proper precautions had been taken to design, maintain, inspect and operate the rides. People expect that reasonable precautions will be taken to ensure that amusement parks, go-kart tracks, water parks and fairs are safe for their children.  Amusement ride accident lawyers have learned that this is not always the case.  Although there are widely accepted industry standards for the design, maintenance, inspection and operation of amusement rides, sometimes corners are cut.  Whether due to ignorance, laziness or greed, when proper precautions are not taken, the results can be catastrophic.  The tragedy is further compounded when the victim is a young child.   Regulation of amusement parks and go-kart centers is left to the states, whose regulations and degree of oversight varies widely.  Typically, state agencies are not provided with the manpower and resources to conduct the necessary inspections to ensure safety.  Rather, this responsibility falls to the ride operators themselves.  Similarly, although the federal Consumer Product Safety Commission has jurisdiction over mobile amusement rides, no federal agency has responsibility for the safety of fixed amusement rides.  This lack of oversight and regulation often results in an amusement ride accident.  Lawyers from our firm have obtained compensation for the victims of these accidents while also calling the industry’s attention to unsafe practices.

Because of our demonstrated success in litigating cases involving an amusement ride accident, lawyers from Karon & Dalimonte have been asked to share their expertise with attorneys throughout the country.   From Massachusetts to the state of Washington;  from Pennsylvania to Oklahoma, where there has been an amusement ride accident, lawyers from Karon & Dalimonte, LLP have been asked to help.  Our partners are experienced amusement ride accident lawyers and are well equipped to take on any challenge presented by the amusement industry.  Among our firm’s successes include the representation of an eight year old girl who suffered terrible injuries when her hair was caught in the motor of a defectively designed Mini-Himalaya amusement ride.  Several other examples include a high school senior who broke her neck because her go-kart lacked a proper seatbelt, a young women who was completely scalped when her hair was caught in the unguarded rear axle of her go-kart, and a women who suffered spinal injuries when taking her nephew and niece on a poorly maintained spinning amusement ride.  Although nothing could undo these tragedies, in each case we obtained a recovery that made an important difference to our clients.   We believe that our efforts have not only obtained needed compensation for innocent victims, but also increased amusement ride safety and helped publicize the need for more effective regulation.

If you or your child has been injured in an amusement ride accident, attorneys may help you obtain the resources to help make things better.  Amusement ride accident attorneys can also help call attention to a problem and possibly prevent someone else’s child from suffering the same fate.  If you would like to speak to one of our amusement ride accident attorneys, we would welcome the opportunity to answer your questions.

As noted above, government regulators lack the budget and legal authority to ensure the safety of amusement rides.  Nonetheless, they do compile useful information and can be a good starting point for an investigation.  The Consumer Product Safety Commission (CPSC) has jurisdiction over fixed amusement rides and has compiled statistics on injuries on these rides.  Some of this information can be accessed at their webiste www.cpsc.gov.  Each state varies in its degree of regulation and the agency charged with amusement ride oversight.  For example, in Massachusetts, amusement ride safety is the responsibility of the Department of Public Safety, in Pennsylvania it is within the purview of the Bureau of Ride and Measurement Standards.

If you would like more information on your state’s regulations or if you would like to speak with an amusement ride accident attorney, please feel free to contact us.
